Section 32
To be treated nationally

(1) After the commencement of this Act, the foreign investment made by a foreigner in Nepal subject to this Act and other prevailing laws shall apply to the management, storage, use, transfer and sale of the investment made by a Nepali person for as long as the investment is in Nepal after such investment has entered Nepal, National treatment will be no less favorable than the conditions applicable to storage, use, transfer, and sale.
(2) Notwithstanding anything written in sub-section (1), in the case of foreign investment that has been approved before the commencement of this Act, the provisions of the prevailing law relating to foreign investment existing at the time of such investment shall be applicable and accordingly any facility enjoyed by any foreign investor shall be affected. No change shall be made without his consent.
(3) According to sub-section (1), the industries with foreign investment will receive the following protection:- Industries with foreign investment will be treated in the same way as industries invested by Nepali citizens of the same nature. Foreign-invested industries and businesses will be free to determine the prices of goods and services within the scope of prevailing laws. Foreign-invested industries and businesses will not be restricted from doing business as prescribed while being limited to their own industries. Foreign-invested industries and businesses will not be restricted from taking profits, repatriating investments, paying interest on loans, and repaying loans.
(4) Notwithstanding anything written in sub-section (1), national treatment shall not be applicable to the following matters:- Compulsory licensing for the creation, limitation, transfer of rights or use of intellectual property mentioned in agreements concluded under the World Trade Organization. Subject to the prescribed arrangements, if any exemption or facility has been given to indigenous industries or goods in accordance with the prevailing Nepalese law on public procurement, the subject of such exemption or facility, the subject of subsidies or concessions to be provided or available from the Government of Nepal, nonThe Government of Nepal is responsible for matters related to business services, financial institutions that have the responsibility to protect investors, securities market participants, insurance policy holders or insurance policy claimants, or to protect the financial interests of a person, and to maintain the soundness (soundness) of financial institutions, ethics or financial responsibility. Measures related to financial services that have been adopted or managed as deemed appropriate, the Nepal Government is or will be a party to any regional or multilateral economic, monetary or similar organization that is a party to the obligation or provision of special treatment by the Nepal Government, return of investment outside Nepal, debt repayment (including principal, interest and fees), matters related to the conditions set by the regulatory body in accordance with the prevailing law for the payment of service fees, matters of human health, animals, plants or environment protection.
